   • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation
   • To impersonate or attempt to impersonate Mobi Weave, Inc., a Mobi Weave, Inc. employee, another user, or any other person or entity
   • You may not upload, post, or transmit any content that is prohibited which is defined below
   • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of our Site or Service, or which, as determined by us, may harm Mobi Weave, Inc. or users of our Site or Service or expose them to liability
2. Registration and User Accounts To use our Service, you must register for an account on our Site and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify Mobi Weave, Inc. immediately of any unauthorized use of your account or any other breach of security. Mobi Weave, Inc. will not be liable for any loss or damage arising from your failure to protect your account information.
3. Ownership and Intellectual Property Mobi Weave, Inc. and its licensors own all right, title, and interest in and to our Site, Service, and all related software, applications, and other services, including all intellectual property rights. You may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of our Site or Service content, except as expressly authorized by Mobi Weave, Inc. You may not use any trademarks, logos, or trade names that appear on our Site or Service without the prior written consent of Mobi Weave, Inc.
4. Payment If you purchase a subscription to our Service, you agree to pay all fees and charges associated with that subscription, including any applicable taxes. You agree to keep your billing information up to date and accurate. Mobi Weave, Inc. reserves the right to change our subscription plans and pricing at any time. You agree to pay all fees and charges associated with your use of CreateVideo.AI. All payments are processed by our third-party payment processor, Stripe. We do not store or have access to your credit card information. Monthly fees are non-refundable. Annual fees are refunded on a pro-rated basis.
5. User Content: You retain all rights to any content (including text, images, videos, audio, and other media) that you upload to CreateVideo.AI. By uploading content, you grant us a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such content on CreateVideo.AI solely for the purpose of providing you with the service. You represent and warrant that you have all necessary rights to upload the content and that the content does not infringe any third party’s intellectual property or privacy rights.
6. Prohibited Content: You may not upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable. Specifically, promoting violence, hate, racist, sexist, anti-Semitic, defamatory content, self-harm, or any other content that violates our community standards is not allowed.
7. Use of Service: You agree to use CreateVideo.AI only for lawful purposes and in accordance with these terms of service. You agree not to use the service for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, or to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
8. Termination: We reserve the right to terminate your access to CreateVideo.AI at any time and for any reason, including without limitation, if we believe that you have violated these terms of service.

11. Disclaimer of Warranties: CreateVideo.AI and its content are provided on an “as is” and “as available” basis. Mobi Weave, Inc. makes no representations or warranties of any kind, express or implied, as to the operation of CreateVideo.AI or the information, content, materials, or products included on CreateVideo.AI. You expressly agree that your use of CreateVideo.AI is at your sole risk.
12. Limitation of Liability: In no event shall Mobi Weave, Inc., its officers, directors, employees, agents, licensors or affiliates be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of CreateVideo.AI or with the delay or inability to use CreateVideo.AI, or for any information, products, and services obtained through CreateVideo.AI, or otherwise arising out of the use of CreateVideo.AI.
13. Governing Law: These terms of service shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
14. Users are not allowed to upload content that infringes on any third-party intellectual property rights, including but not limited to copyrights, trademarks, and patents.
15. CreateVideo.AI reserves the right to remove any content that violates these terms of service, without notice or liability.
16. CreateVideo.AI does not claim ownership of any content uploaded by users. However, by uploading content to the site, users grant CreateVideo.AI a non-exclusive, worldwide, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute the content for the purpose of providing and improving the services offered by CreateVideo.AI.
17. Users are responsible for ensuring that any content they upload to CreateVideo.AI does not contain any viruses, malware, or other harmful code that could damage the site or interfere with the user experience of other users.
18. CreateVideo.AI reserves the right to modify or discontinue any part of the service at any time, with or without notice or liability to users.
19. CreateVideo.AI is not responsible for any loss or damage caused by the use of the site or any content uploaded to the site. Any legal action or proceeding arising from or related to these terms of service or the use of the site shall be brought exclusively in the federal or state courts located in San Francisco, California.
22. If any provision of these terms of service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
23. CreateVideo.AI may assign these terms of service, in whole or in part, at any time without notice to users. Users may not assign these terms of service or transfer any rights or obligations hereunder without the prior written consent of CreateVideo.AI.
24. The failure of CreateVideo.AI to exercise or enforce any right or provision of these terms of service shall not constitute a waiver of such right or provision.
25. These terms of service are binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns.
